WPIX's "Oahu Be My Valentine Giveaway" Official Rules

1. HOW TO ENTER & WIN: No purchase necessary; must be 18 years of age or older and a legal resident of Connecticut, New York or New Jersey at the time of entry. Sweepstakes begins at 8:00 AM EST on January 29, 2010 and ends on Sunday, February 7, 2010 at 11:59PM EST. To enter the "Oahu Be My Valentine Giveaway" (the "Sweepstakes"), watch the WPIX Morning News for the Sweepstakes Keyword (PINEAPPLE), then log onto the WPIX Morning News website (WPIX.com/morningnews) and complete the official entry form, submitting your name, age, e-mail address, telephone number and Sweepstakes Keyword. Only entries with the correct Sweepstakes Keyword will be eligible. Entries must be received by 11:59PM EST on Sunday, February 7, 2010. Entrants must use their own name. Copies or other mechanical reproductions, facsimiles, entries containing technical or electronic reproductions, e-mail entries containing attached files are not eligible and will be rejected. Sponsors are not responsible for Internet connections, unavailability of servers or any other technical malfunctions that may interfere with an entrant's ability to enter. If any dispute arises as to identity of entrant, entrant shall be considered person who owns Internet account through which entry was submitted. Limit one entry per person and per e-mail address; subsequent entries from the same person or same email address will be disqualified. Any entry sent with an attachment shall be disqualified.

2. SELECTION OF WINNER: One (1) entrant will be selected at random from among all eligible entries received and will tentatively be declared the Winner, subject to verification and compliance with these rules,.

3. PRIZE: The Winner will receive a Oahu Be My Valentine package including: roundtrip airfare for two (maximum value of $900/person; coach class) from a New York City-area airport (determined by Sponsors) to [Honolulu International Airport] Oahu, Hawaii; a five-night stay (one standard room, double occupancy) at [HIlton Hawaiian Village Beach Resort & Spa]. Total ARV: $3,100 . Note that the ARV may be different from the actual value of the prize based on date and times of travel; any differences will not be awarded. Winner is solely responsible for all applicable federal, state, local and taxes incurred in connection with receipt and use of the Prize. Winner will receive an IRS Form 1099 for the year in which the Prize is awarded from the Sponsors for the total ARV indicated in these rules.

Conditions of Travel Elements: Winner and his/her guest must be eighteen years of age at the time of travel, must travel on the same itinerary, and must possess all required travel documents. Winner and his/her guest will be required to execute and return a liability/publicity release prior to travel. Travel may only be redeemed on the dates and at times determined by Sponsors (February 28, 2010 and February 28, 2011. Air travel is non-transferable, not changeable and not valid for upgrades and/or frequent flyer miles. Winner and his/her guest will be responsible for all airport taxes, passenger facility charges or fees, and any other fees and expenses incurred in connection with redemption of the Prize. Travel and hotel accommodations are subject to availability. Winner or his/her guest may be required to present at least one valid major credit card in order to check into hotel room. Sponsors shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or any other persons or entities providing any prize elements or services.

Additional Prize Conditions: Items, costs and expenses not specifically identified as being included as part of the Prize are the sole responsibility of the Winner and his/her guest, including, by way of example, local ground transportation; travel insurance; baggage fees; food, beverages, gratuities or entertainment expenses; room service and any other hotel incidentals and/or charges; and/or any other incidental cost or expense not specifically identified as part of the Prize. No prize substitutions will be made except at the sole discretion of the Sponsors, which may substitute a prize of greater or comparable value. If the Winner is not able to redeem the Prize in accordance with these rules and/or sponsor requirements, or otherwise fails to use or redeem any element of the prize, Winner shall forfeit the prize (or such prize element) and no additional or substitute prize or compensation will be provided. If Winner elects to travel without a guest, no additional compensation will be awarded. All travel must be completed by one (1) year from date of issue. If Winner is unable to travel by this date, prize will be forfeited. Travel must originate and end at the airport designated by Sponsors. Travel is subject to availability and certain other restrictions, which are subject to change in the sole discretion of the designated carrier. Sponsors will not replace any lost or stolen tickets or Travel Certificates. Once booked, no change, extension, or substitution of trip dates is permitted, except by Sponsors at their sole discretion.

4. WINNER NOTIFICATION & PRIZE DELIVERY: The winner will be notified on or about February 12th, 2010; provided, however, that if a winner is determined to be ineligible, cannot be reached within a reasonable amount of time, or otherwise fails to comply with Sweepstakes Rules, that entrant shall be disqualified and another winner will be selected.

5. PRIZE RESTRICTIONS: Prizes are non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. No prize substitutions will be made except at the discretion of the Sponsors, which may substitute a prize of greater or comparable value. If any prize becomes unavailable for any reason, Sponsors reserve the right to substitute a prize of comparable value. Winners assume all applicable tax liability for their prize.

6. CONDITIONS & RESTRICTIONS: Entrants agree that Sponsors have the sole right to decide all matters and disputes arising from this Sweepstakes and that their decisions are final and binding. Except where prohibited by law, entrants 18 years of age and older agree to allow use of their name, voice, photograph, likeness and any information provided on entry form, in any medium of communication, including print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsors and their respective affiliates or sponsors, without additional compensation. By acceptance of a prize, winner agrees to release, indemnify and hold harmless Sponsors, their respective parent companies and affiliated entities, and each of their respective employees, representatives, contractors, sponsors and advertisers, from any and all liability, loss, damage, costs or claims related to any allegation regarding the award of, the receipt of, or the use of their prize. Sponsors are not responsible for personal injury of any prize winner incurred in connection with the use of their prize. Winner and guest may be required to supply proof of identity, age and residence, and to execute an affidavit of eligibility and release of liability prior to receiving their prize.

7. ELIGIBILITY RESTRICTIONS: Sweepstakes is open to legal residents who, at the time of entry, are 18 years of age or older and reside in Connecticut, New York or New Jersey. Sweepstakes is not open to employees of Sponsors. Immediate family members, employees or immediate family of any of Sponsors' affiliated companies, licensees, advertising or promotional agencies, or sponsors are also ineligible.

8. INTERNET: If for any reason, the Internet-related portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes, Sponsors reserve the right, in their sole discretion, to terminate or suspend the Sweepstakes or any portion thereof. Any attempt to damage or undermine the fair and legitimate operation of the "Sweepstakes" will result in disqualification. Information submitted in Internet entries, including entrant's name, address, e-mail address, etc., may be used by Sponsors for marketing or promotional purposes. This Sweepstakes shall be governed and enforced pursuant to New York law, excluding choice of law provisions.
